• MRC IS DECLARED LEGAL BY MOMBASA COURT

25TH JULY 2012 The Mombasa Republican Council is now free to operate. A three judge bench of the High court in Mombasa has today declared that the movement which has been accused of calling for secession especially through its slogan, Pwani si kenya, was legal and urged its members to form a political party through which they can voice their concerns. However, attorney general Githu Muigai has indicated that his office will appeal that decision arguing that the court did not consider legitimate constitutional concerns of the government. The AG asserts that any group or organization challenging the constitutional authority and territorial integrity of the republic of Kenya cannot enjoy protection by the constitution. Andrew Ochieng reports.

SOUNDBITE: (English) Antti Lehmusjarvi, European Union Legal advisor: "The prosecutor yesterday, and he was quite happy with the amount of evidence and technical support we were provided in the last two cases. Of course the prosecutor will start now with these pirates, which were now handed over from this ship. But, as I said, we are not aware of any particular problems. Of course there is an independent legal procedure in Kenya and we will wait what the Kenyan court will decide." 12. Wide of police vehicles with suspected pirates driving out of port STORYLINE: French commandos in the Kenyan port of Mombasa marched a band of suspected pirates down the gangplank of a French naval frigate on Wednesday, before turning the 11 Somali men over to Kenyan authorities. French officials say the suspects will be tried for their alleged attack on the Liberian cargo ship Safmarine Asia last week. The three French commandos, who may have been part of the pre-dawn raid that captured the pirates on April 14, wore black balaclavas to conceal their identities. The pirates, who did not smile or speak to gathered reporters as they left the Nivose, appeared to range from in age from about 20 to 40. Few wore shoes. They were not handcuffed or shackled. The men were rushed from the ship into a waiting Kenyan police van. Kenyan officials received the men and took the pirates' equipment: two skiffs, three grappling hooks, four rusty assault rifles, two bags of bullets and a ladder. The Nivose is serving in the international fleet trying to protect the 20,000 ships that pass through the vital Gulf of Aden trade route every year. The ship pulled into dock at 9 a.m. (0600 GMT) and anchored next to the German frigate Rheinland-Pfalz, which earlier this month handed over to Kenya seven men they captured after they attacked a German naval supply ship off the Somali coast. The captain of the Nivose, Jean Marc LeQuilliec, said sailors pursued the pirates in a dramatic night time chase and caught them in the early raid. "They received two boats on each side and the helicopter just on top of them so they didn't want to resist," he said. France has traditionally been aggressive in fighting piracy. Antti Lehmusjarvi, the legal adviser to the EU's anti-piracy force, said he thought the trials would go smoothly. including one on Monday when pirates fired rockets at a Maltese-flagged ship off Yemen's coast. http://www.ktnkenya.tv If you want to secede, you better follow the law; this is the message from a three-judge bench in Mombasa, that legally lifted the ban on the Mombasa republican council. However the ban was lifted with various caveats, one being, that the MRC's call for secession is illegal under the constitution and if the group truly believes 'Pwani si kenya', they must petition for separation legally. KTN's Kathryn Omwandho has more on this ruling that may not necessarily be in the favour of separatist movement

The seizure of over seven hundred elephant tusks in Mombasa has raised pertinent questions regarding the laws against trading in contraband game trophies. This year alone over 18 of such cases have been reported with only two so far successfully prosecuted in court. Even then the penalties were not anything to talk about, thus encouraging repeat offenders. KWS blames this on the weak wildlife legal infrastructure. KTN's Mercy Kandie with the details.

Mombasa Governor Ali Hassan Joho could lose his seat if any Kenyan High Court decides to nullify his election on account of a report by Uganda's National Council for Higher Education. Legal experts say a court doesn't have to wait for a petition on Joho's eligibility but it can rely on the confirmation and authentication of the report issued yesterday recommending the revocation of Joho's degree he claims to have attained from Kampala University over doubts of its genuineness. Jubilee party candidates and some residents of Mombasa have launched a city clean up exercise in the county. The team cleared piles of filth on roads and several streets in Mombasa central business district. They complained about dumping of garbage on road reserves and public areas, something which could have effects on the health of locals and visitors. Led by Jubilee Mvita Parliamentary candidate Omar Shallo, the group asked the Mombasa county government to do its job of collecting garbage and keeping the resort town clean ahead of the tourism high season.
